A healthy environment implies, among other things, breathing clean air, having access to clean water and quality food, and having a decent place to live.
AIDA’s work as an international environmental organization began in 1998 with the La Oroya case. Since then, we’ve worked to demonstrate how the violation of the right to a healthy environment—due to air pollution with heavy metals from a smelter—has violated the rights to life and health of residents of the city of La Oroya, Peru.
We’ve shown how the impacts have been differentiated for women, children, and the elderly. And we’ve demanded that the Peruvian State take urgent measures to guarantee the rights of the affected population. In 2005, we took the case to the Inter-American Commission on Human Rights, which in September 2021 brought it before the Inter-American Court after establishing the international responsibility of the State. It will be one of the first cases to centrally address the indivisible relationship between a healthy environment and other human rights.
After 16 years of waiting, this year the case will have one of the most important moments in its history. On October 12 and 13, the Inter-American Court of Human Rights will hold the public hearing of the La Oroya case, in which it will decide on the exceptions to the case, hear witnesses and experts, and hear the final arguments of the parties.
AIDA has carried out various preparatory activities for this hearing, within the framework of the case strategy: informative meetings with the victims of the case, meetings with allies and experts to coordinate legal documents and expert opinions, and preparation of a communication and advocacy strategy. We have the support of experts from the region, organizations from different parts of Latin America, and United Nations Rapporteurs with expertise in environmental issues, environmental health, and international law. We have also worked on the analysis and drafting of the legal arguments for the case strategy.
After the hearing, it is expected that the Court will issue a judgment recognizing the responsibility of the State of Peru for the human rights violations proven in the case and determine reparation measures for the victims.
La Oroya has been the most emblematic case in AIDA, since the organization’s inception. We have been working actively to bring the justice and reparations the people from La Oroya deserve for more than two decades of harms. We will continue to work toward upholding the right of those who have suffered the most to a healthy environment.
