Final Push: Fund Ancestral Land Justice

To our valued donor, we extend our deepest gratitude for your commitment. Your singular generous contribution to this cause stands as a powerful testament to the necessity and moral clarity of our mission. While we celebrate your partnership, I must also convey the stark reality: this pivotal case, despite securing major legal leverage and international recognition, is being sustained almost entirely through my own personal sacrifice as the Lawful Attorney and principal petitioner. We hope this report on our critical progress will motivate the wider community to urgently join this crucial fight.

Strategic Legal Update: Leveraging Precedent for Final Judgment

The defense of the Huahi Achama Tutuwaa Royal Family’s ancestral land is now entering a decisive trial phase, building upon prior court judgments that have successfully established and clearly delineated the territorial boundaries of the Benimasi-Boadi Indigenous Community lands. This crucial legal prerequisite now allows us to deploy targeted judicial action against institutional exploitation.

Our current suit against the Kwame Nkrumah University of Science and Technology (KNUST) and the Land Commission has yielded two key outcomes:

  1. GH¢1,000,000 Compensation Guarantee Secured: In its ruling on our motion for an Interlocutory Injunction in July 2025, the High Court determined that the balance of convenience weighed against halting the operations of a public university. However, the Court granted an equally powerful remedy: it ordered KNUST to execute an Undertaking to pay GH¢1,000,000 (approximately $85,000 USD) as compensation as part of damages incurred should the Royal Family succeed in the main suit. This compensation guarantee serves as an alternative to the injunction, legally solidifying the financial risk for the defendant and confirming the high valuation of the Family's claim prior to trial.

  2. Expedited Trial Ordered: After denying our subsequent motion for a default judgment, the Court set the case down for an expedited trial to finally determine the rights of the parties, with the next critical date being the Case Management Conference (CMC) on December 9, 2025.

The Kumasi Court of Appeal: Challenging Systemic Miscarriage of Justice

A separate but equally critical legal battle is the pending appeal before the Kumasi Court of Appeal. This appeal addresses a serious miscarriage of justice at a lower court, which we contend was a direct result of interference emanating from Manhyia Palace and the subsequent abuse of court processes. This abuse included irregular procedures that deliberately sought to frustrate the Family's rights and deny them due process. The appeal is our last resort within the judicial system to reverse a clearly biased ruling and uphold the principle of legal impartiality against powerful traditional and political influence. While the Chief Justice advised us to stick to the judicial process (denying a transfer to Accra), we remain steadfast in our commitment to winning the appeal on merit.

Upholding Professional Ethics and Addressing Security Concerns

I am actively prosecuting a formal professional misconduct complaint against the opposing solicitor before the General Legal Council (GLC) Disciplinary Committee. This essential proceeding targets the alleged professional impunity and conflict of interest that has historically obstructed justice for the Royal Family. Following the submission of my robust Rebuttal in September 2025, I currently await the GLC's scheduling of the matter for trial. Crucially, due to the well-documented security risks associated with my current refugee status in the United States, I have formally requested permission to appear virtually before the Disciplinary Committee, a measure essential for protecting my safety while ensuring full participation in this critical ethics proceeding.

Global Advocacy, Media Reach, and Literary Legacy

The significance of the Benimasi-Boadi struggle has successfully been elevated to a globally recognized human rights and climate justice issue, providing a vital layer of protection and external pressure. Our advocacy has resulted in feature articles across prominent international platforms:

These publications enhance our credibility and support the progress of our book project, "The Last Guardian of Ashanti," which is currently in development to serve as a permanent historical and legal record of the Huahi Achama Tutuwaa Royal Family’s resilience.

Financial Reality and Critical Funding Shortfall

Despite securing a GH¢1 million court-ordered guarantee and achieving significant global visibility, this high-stakes legal campaign has fully depleted our limited resources. The defense of these ancestral rights is currently being sustained by an extraordinary, round-the-clock personal sacrifice: as the principal petitioner and Lawful Attorney, I, Nana Kwesi Osei Bonsu, have committed an astonishing 80% of my hard-earned personal incomeincome earned by working 15 hours a day, 7 days a week, often sleeping in my car for two consecutive weeks while driving ride-share in Cleveland—to cover the high-cost, international legal fees and logistical expenses since the inception of this fight. It is from the front seat of that vehicle that I routinely transfer necessary funds to our Ghanaian legal team at 3 a.m. (EST) to meet urgent court deadlines.

This reliance on personal funds is inherently unsustainable and constitutes the mission's critical vulnerability. Land Rights Defenders Inc. is now facing an existential funding gap: securing immediate and substantial external funding is non-negotiable for proceeding with the crucial expedited trial in December. The upcoming proceedings require intensive capital for senior legal counsel, essential logistics to facilitate my remote participation (given the security concerns tied to my refugee status), and the travel costs for mandatory key witnesses to attend the critical December 9th Case Management Conference (CMC) and subsequent hearings.
