Beneficiaries of temporary protection continue to face significant challenges in Hungary. In August, the Hungarian Helsinki Committee submitted recommendations to the newly elected government on the legal amendments needed to address some of these difficulties.
EU rules on temporary protection establish minimum standards aimed at ensuring the swift and effective protection of people fleeing war. However, the Hungarian legal framework, which has been amended several times in recent years, continues to diverge from these minimum standards in several important respects. First, it defines more narrowly the group of people eligible for temporary protection status. Second, it still does not ensure the possibility of applying for asylum in Hungary, either for beneficiaries of temporary protection or, due to the incorrect transposition of EU law, for persons excluded from temporary protection status. Third, it unjustifiably restricts access to state-provided housing for persons granted temporary protection and for dual nationals fleeing Ukraine.
The package of proposals presented below by the Hungarian Helsinki Committee aims to address these three problems through targeted and limited amendments to the relevant legislation.
