Monitor Public Investment in Cartagena, Colombia

Thank you for donating to Vigila Cartagena, for believing in a project that loves this city and investigates public investment. In March 2019 we sent you a report about our work and today we want to update you on our achievements and the effect we have had in our community. 

Through our investigative work we have achieved the following: 

• The Attorney General's office took preventive measures following Funcicar‘s concerns about quality irregularities in several contracting processes in the mayor’s office (Alcaldía de Cartagena Localidad 2). 

• The City Council (Concejo Distrital) implemented our recommendations regarding insufficient requirements in the contracting process for a public investment worth $391MM.

• The Soledad Acosta de Samper school overhauled their contracting process as a result of Funcicar’s recommendations, which in turn lead to a better quality building. 

• The Attorney General's office and other government agencies that investigate corruption have opened investigations and implemented preventative strategies as a direct result of Funcicar investigative work.

• Important management decisions to safeguard public integrity from irregularities that we identify. One of these decisions was to withdraw the previous Secretary of Infrastructure from office, in part, for the alerts issued by Vigila that involve alleged property detriment in the construction of 3 city parks. • Government control entities, such as the Attorney General's office and government comptrollers, use us as a resource, which was the case with the Edurbe early childhood project contract.

• Community leaders and journalists have replicated our research model.

• We are an active voice in national political debates, and were invited to observe a meeting regarding the accountability and transparency of the Attorney General's Office. 

Now, some achievements about city-wide projects we follow...

1. River and natural reserve Juan Angola

We affected the suspension of the Edurbe - District agreement because it did not have the technical requirements of the law that would guarantee the quality of the investment, case alerted by Vigila Cartagena. See more.

We also train community leaders to monitor the reinvestment of these public resources (picture 1), and supported the creation of an Environmental Development Plan (Plan de Desarrollo Ambiental) in which local communities played an important role.

2. School Food Program (Programa de Alimentación Escolar 2019)

The Mayor's Office of Cartagena extended the terms of the call for the contracting process after our reports. However, as there were no bidders in this process, they proceeded to contract through commercial exchange, we were invited by the mayor to oversee these processes and guarantee legality. 

In addition, the Mayor's Office applied our recommendations regarding the need for greater transparency in the hiring process for contractors via changes to social media. (picture 2).

3. Coastal Protection

The Attorney General's Office requested an open call for contract works related to coastal protection constructions following Vigila Cartagena alerts. See more.

4. National Games (Juegos Nacionales Bolívar 2019)

We issue observations and alerts about the tender for works at the Jaime Morón Stadium, which is why the process was discarded and reopened, the second time  including the suggested adjustments from Vigila Cartagena. Given our recommendations, information access strategies have been implemented in hiring hearings. We advocate for greater citizen involvement regarding these processes in the public City Council hearings.

Apreciado aportante de Vigila Cartagena, ¡gracias por creer en este proyecto que ama a nuestra ciudad y está haciendo control a la inversión pública! En marzo del 2019 te enviamos el último informe sobre sobre nuestro trabajo, hoy queremos contarte más sobre nuestros logros e incidencia.

A través de nuestra participación en diferentes instancias de control institucional, logramos que...

- Procuraduría inició acción preventiva a raíz de nuestras alertas sobre presuntas irregularidades en proceso de contratación de la Alcaldía Local 2 para capacitaciones sobre gestión de calidad, en isla privada.

- El Concejo Distrital acogiera nuestras recomendaciones orientadas a que se  ampliaran los elementos de análisis en el estudio y aprobación de un proyecto de crédito público solicitado por el Distrito por $391MM.

- La Institución Educativa Soledad Acosta de Samper solicitara nuestra vigilancia a un proceso contractual de obras que adelantó y posteriormente descartara y volviera a abrir la contratación para acoger a cabalidad los ajustes sugeridos.

- Los Entes de Control iniciaran acciones preventivas e investigaciones a raíz de alertas y denuncias del programa.

- Importantes decisiones de la administración para salvaguardar la integridad pública a partir de irregularidades que identificamos. Una de estas decisiones fue retirar del cargo a la anterior secretaria de Infraestructura, en parte, por las alertas emitidas por Vigila que involucran presunto detrimento patrimonial en la construcción de 3 parques de la ciudad. - Somos fuente para investigaciones de entes de control: caso Edurbe contrato primera infancia: Procuraduría y Contraloría.

- Medios de comunicación y líderes comunales repliquen nuestro modelo de investigación.

- Somos una voz activa en el debate: Invitados a la Rendición de Cuentas de la Procuraduría General de la Nación.

En cuanto a proyectos de ciudad...

• CAÑO JUAN ANGOLA: Incidimos en la suspensión del convenio Edurbe - Distrito por no contar con los requerimientos técnicos de ley que garantizara la calidad de la inversión, caso alertado por Vigila Cartagena. Ver más. También formamos a líderes para el seguimiento e incidencia en la reinversión de estos recursos (ver imagen 1), y apoyamos la formulación de un Plan de Desarrollo Ambiental con las comunidades del sector.

• Programa de Alimentación Escolar 2019: La Alcaldía de Cartagena amplió los plazos de la convocatoria luego de nuestras observaciones. No obstante, al no contar con proponentes en este proceso, se procedió a contratar a través de la bolsa mercantil y fuimos Invitados por el alcalde a conocer las etapas y garantías de la contratación mediante esta figura. Además la Alcaldía acogió nuestras recomendaciones sobre dar mayor visibilidad al proceso de contratación a través de sus redes sociales (ver imagen 2).

• Protección Costera: La Procuraduría solicitó convocatoria abierta para contratar obras de este proyecto, ante alertas de Vigila Cartagena sobre uso de invitación cerrada. Ver más.

• Juegos Nacionales: Emitimos observaciones y alerta sobre la licitación para obras en el Estadio Jaime Morón por lo cual se descartó el proceso y se volvió a convocar atendiendo los ajustes sugeridos. Ante nuestras recomendaciones, se han implementado estrategias de acceso a la información en audiencias de contratación. Motivamos la audiencia de control político en el Concejo Distrital.

LOGROS Y ACCIONES:

¡Hemos movilizado a la ciudadanía de Cartagena hacia la lucha contra la corrupción!... para eso:

• Documentamos presuntas irregularidades en la contratación del gobierno de nuestra ciudad y de nuestro departamento (Bolívar) las difundimos por medio de piezas de comunicación que llamamos “alertas”. Hasta el momento han sido 28. Consúltalas aquí
• Formamos a más de 1.350 personas en mecanismos de lucha anticorrupción en distintos talleres y reuniones. La mayoría de ellos son líderes de las comunidades que tienen un rol activo en la vigilancia a la inversión pública en sus barrios.
• Tuvimos la primera reunión de nuestro Comité Ciudadano de Lucha Contra la Corrupción. Leer más.

Sacamos a la luz cómo se manejan nuestros recursos analizando, consolidando y difundiendo cómo va la inversión pública en 6 informes. Este año, 2019 lo iniciamos con la publicación del informe sobre los financiadores de las campañas de los congresistas de nuestro departamento, Bolívar, y del último alcalde electo. Ver más

Aportamos insumos al control fiscal, penal y disciplinario, los organismos encargados de este seguimiento están priorizando los temas que vigilamos.

• Documentamos y presentamos 9 denuncias ante entres de control.
• Realizamos 15 mesas de trabajo con entes de control: 5 con la Procuraduría (control disciplinario), 2 con la Fiscalía (acción penal), 1 con la contraloría (control fiscal), 3 con la CGN, 1 con la Secretaría de la Transparencia, 1 con el Concejo, 1 con la DIAN.

Seguimos cuidando los recursos que amparan a nuestra niñez, tercera edad y comunidades.

• Identificamos deficiencias en los requisitos de los contratos de la Alcaldía de Cartagena y presentamos 52 documentos con 186 observaciones, de las cuales, 86 fueron acogidas.
• Asistimos a las audiencias donde la Alcaldía de Cartagena o la Gobernación de Bolívar definen los requisitos finales que exigirá cierto contrato y a las audiencias donde se elige a los contratistas. En total, han sido 38.
• Vamos a campo a verificar la inversión. Ya hemos hecho 6 visitas a parques, canchas, al Coliseo Northon Madrid y a la prueba de conocimiento de aspirantes a contralor/a Distrital. En este año, 2019 visitamos 3 parques y 1 cancha para comprobar cómo fue la inversión… ¡pronto tendremos noticias sobre lo que encontramos!

También, hemos realizado 7 mesas de trabajo con expertos para impulsar la cualificación de lo que hacemos.

Vigila Cartagena es una iniciativa colectiva de ciudad, liderada por Funcicar y respaldada por ciudadanos, organizaciones y empresas, que desde el año 2017 está identificando malas prácticas de contratación con el fin de minimizar los riesgos de corrupción, promover la transparencia y la calidad de la inversión pública.

What we have done? 2018-2019

In our last report we told you about our work until november/2018. Today we have news about all our work until this march!

ACHIEVEMENTS AND ACTIONS:

We have awaken citizens to have an active role in the fight against coruption! To do that…

• We keep record of possible public contract’s bad practices of Cartagena’s goverment and Bolivar’s goverment as early alerts and diffuse them as infographics, reports or videos. Until now, we have published 28. See more
• We continue monitoring the progress of the following infrastructure projects: Coastal Protection, rain drainage master plan, Fifth Avenue of Manga neighborhood, and works for the National Games 2019.
• We have trained more than 1.350 people in topics related to fight against corruption in differents workshops and meetings. More o that people are leaders that watch over the public contract in their neighborhoods.
• We had the first meeting of our Fighting Against Corruption Citizens Committee. Reed more

We bring to light how our public money is managed analyzing, consolidating and diffusing it in 6 reports. This year, 2019, we published our Campaign Finance’s Report about the lasts two votes we had: Bolivar’s Congress Members and Cartagena’s Mayor.

We give supplies to fiscal, penal and disciplinary control. The public entities in charge of this monitoring are prioritizing the issues that we monitor.

• We document and file 9 complaints.
• We had 15 working groups with control entities. Some of them were this: 5 with Procuraduría (disciplinary control), 2 with Fiscalía (criminal action), 1 with Contraloría (fiscal control) and 1 with presidential department of transparency.

We still watching over the public money destined to our kids, seniors and communities.

• We have identified deficiencies in the requirements of the contracts of Cartagena’s goverment and presented 52 documents with 186 observations, 86 of them were accepted, so the requirements were improved.
• We attend the hearings where the Cartagena’s goverment or Bolivar’s goverment define the final requirements that a certain contract will require and the audiences where the contractors are chosen. In total, they have been 41.
• We make field visits to verify the investment: we have already made 6 visits. This year, 2019 we visited 3 parks and 1 sports field to see how the investment was ... soon we will have news about what we found!

We also have made 7 work meetings with experts to promote the qualification of our work.

Vigila Cartagena is a collective initiative of the city, led by Funcicar and supported by citizens, organizations and business. Since 2017 is identifying public contract’s bad practices in order to minimize corruption risks, promote transparency and quality of public investment.

En el último informe que te enviamos, te informamos sobre el trabajo que habíamos realizado hasta junio. ¡Hoy tenemos noticias sobre nuestro trabajo de julio a noviembre! 

Acciones:

• Seguimos enviando alertas tempranas sobre posibles malas prácticas de contratación. En total, lo hicimos para 18 procesos relacionados con construcción, el Programa de Alimentación Escolar, los contratos del Distrito con la cuestionada empresa Edurbe y más. 

• Continuamos monitoreando el progreso de los macroproyectos de infraestructura: Protección costera, plan maestro de drenaje pluvial, quinta avenida de Manga, obras para los Juegos Nacionales 2019. 

• Publicamos 3 informes más sobre: contratación en el Distrito, contratación en las entidades locales y contratación de personas. Ver aquí. 

• Presentamos recomendaciones sobre contratación a dos entidades más: la Alcaldía Mayor y la Secretaría de Transparencia Nacional. Además, entregamos recomendaciones a las directivas de una Institución Educativa del Distrito. • Hemos publicitado 296 procesos de contratación del Distrito a través de redes sociales. Así contribuimos a la democratización de la contratación.

Talleres con la comunidad.

En esta parte del año, tuvimos 18 talleres y eventos con la ciudadanía. Por ejemplo, hemos brindado a líderes comunales herramientas y habilidades que les permiten monitorear la ejecución de proyectos en sus zonas de influencia: 

• Taller con líderes comunales de siete barrios cercanos al Juan Angola, cuerpo de agua en el cual se viene planeando una inversión importante. 
• Taller con líderes comunales, representantes del Consejo Territorial de Planeación (CTP), y de los tres Consejos Locales de Planeación de la ciudad (CLP); personas encargadas de evaluar el Plan de Desarrollo Distrital de la Ciudad y los planes de Desarrollo Locales, respectivamente. Con nosotros, están ´recibiendo formación sobre la inversión del Distrito y cómo se usa para ejecutar ese Plan.
• En alianza con otras organizaciones, hemos hecho seis "Corruptours", un recorrido por siete lugares de Cartagena afectados por la corrupción. Mostramos los casos de manera dinámica, con humor, música y datos de investigaciones oficiales, no promoviendo los problemas de la ciudad sino despertando de la indiferencia a la ciudadanía. Estamos seguros de que si asumimos nuestro rol como ciudadanos podemos cambiar la cultura de la corrupción. Cuatro “Corruptours” fueron con niños: desde las nuevas generaciones, vacunándolos contra la corrupción.

Vigilancia de la adjudicación y ejecución de los contratos.

Estamos en audiencias de asignación de riesgos y de adjudicación de contratos. Hasta ahora, hemos estado en 17 reuniones dando nuestras observaciones a los procesos.

Además, visitamos las obras del coliseo Northon Madrid Coliseum, proyecto de infraestructura intervenido en el marco de los Juegos Nacionales 2019. Descubrimos que había problemas con la calidad de algunos productos, como en la pintura utilizada.

Actions

• We still sending early alerts about possible bad practices. In total, we made it for 18 hiring processes related to construction, school feeding program, District’s contracts with ‘Edurbe’ (a controversial company) and more.

• We presented recommendations on hiring in two entities more: District Mayor's Office, and the national Transparency Office. In addition, we did it for a public school.
• We have publicized 296 recruitment calls of the District through social networks; this is how we contribute to the democratization of hiring.

Workshops with community

This part of the year, we have had 18 workshops and events with the citizenship. For example, we have given tools and skills that allow community leaders monitor the execution of projects in their communities:

• Workshop with community leaders who live near a waterbody called “Juan Angola”. The District wants to execute projects in it and the community is learning to watch over it.
• Workshop with community leaders from Cartagena’s three local municipalities. They are in charge of evaluating the City’s Development Plan, and with us, they are learning about the District’s investment and how it is use to execute that plan.
• In alliance with other organizations, we have done six “Corruptours”, a tour around seven places of Cartagena affected by corruption. We showed those cases with activities, jokes, music and official investigation data, not promoting the city’s problems but trying to quit the citizens’ indifference about corruption. We are sure that if we assume our roll as citizens we can fight against corruption and change the culture. Four of this “Corruptours” were with kids, so we are changing it since the new generations, vaccinating them against corruption.

Watching over the contracts’ award and execution

We are in the meetings where the District analyze with the contractors possible risks at the execution of the contracts and in the meetings where the District award the contracts. Until now, we have been at 17 meetings giving our observations about the contracts.

Furthermore, we visited the “Northon Madrid Coliseum”, one infrastructure project for the National Games 2019. We found out that there were problems with some products’ quality like in the paint used.

Ya cumplimos medio año desde que empezamos a trabajar juntos para monitorear la inversión pública en Cartagena. Con tu valioso aporte han sido muchas las acciones y los logros que hemos alcanzado y queremos compartir contigo:

Acciones:

-Convocamos y comprometimos a la ciudadanía a unirse al equipo del control ciudadano con el foro "Cartagena en Acción”.  En este espacio se compartieron propuestas de líderes ciudananos, representantes de los gremios, la academia, y cerramos con unas palabras de apoyo del Procurador general de la Nación. -Emitimos alertas sobre posibles malas prácticas en 5 procesos de contratación relacionados con la construcción y reparación de parques en distintos barrios de la ciudad. Lee más aquí.

-Seguimos vigilando los avances de Protección Costera, Plan Maestro de Drenajes Pluviales y las Obras para los Juegos Nacionales 2019.  

-Publicamos un informe sobre la contratación en las 3 alcaldías locales. Consúltalo aquí.

-Presentamos recomendaciones sobre contratación a Edurbe,  la Alcaldía Distrital y la Gobernación de Bolívar.

-Hemos difundido las convocatorias de contratación del Distrito a través de redes sociales; así aportamos a que se democratice la contratación.

Logros:

• Los entes de control están adelantando investigaciones a partir de denuncias que les presentamos.
• Fomentamos mayor rigor técnico en algunos procesos de contratación. A partir de nuestras observaciones, la Alcaldía ha ajustado los siguientes contratos:

• Alimentación al Adulto Mayor
• Programa de Alimentación Escolar- PAE
• Vigilancia en Instituciones Educativas Oficiales

Todo esto ha sido resultado de un trabajo colectivo y es muestra del poder ciudadano. Sin embargo, todavía falta mucho por hacer. 

Las donaciones recaudadas para el programa permitirán soportar los costos hasta el mes de noviembre de 2018. Con esto hemos contratado a 4 de los 10 miembros del equipo: directora del proyecto, investigador de contratación, abogado y comunicador.

Nuestra incidencia podría mejorar si, por ejemplo, contáramos con un ingeniero que identifique irregularidades en obras de gran cuantía como la intervención a Instituciones Educativas que la empresa Edurbe llevó a cabo.

We have already completed half a year since we began working together to monitor public investment in Cartagena. With your valuable contribution there have been many actions and achievements that we want to share with you:

Actions:

-We commited the citizenship to join us with the forum "Cartagena in Action." In this space there were shared proposals of local leaders, representatives of the industries, the academy, and closed with a few words of support from the Attorney General of the Nation. Relive the best moments here.

-We sent early alerts about possible bad practices in 5 hiring processes related to the construction and repair of parks in different neighborhoods of the city. Read more here.

-We published a report on hiring in the 3 local municipalities. Check it here.

-We presented recommendations on hiring in 3 local entities: Edurbe, the District Mayor's Office and the Governor's Office of Bolívar.

-We have publicized the recruitment calls of the District through social networks; this is how we contribute to the democratization of hiring.

Achievements:

-The control entities are carrying out investigations based on complaints that we presented to them.

-We promote better technical rigor in some hiring processes. Based on our observations, the Mayor's office has adjusted the following contracts:

• Food for the Elderly
• School Feeding Program - PAE
• Surveillance in Official Educational Institutions

All this has been the result of collective work and is a sign of citizen power. However, there is still much to be done.

The donations collected for the program will support the costs until November 2018. With this money, we have hired 4 of the 10 team members: project director, hiring researcher, lawyer and communicator.

Our impact could improve if, for example, we had an engineer who identifies irregularities in large-scale works such as the intervention to Educational Institutions that the Edurbe company carried out.

Los primeros meses de 2018 han sido muy activos para el equipo de Vigila Cartagena. Luego de recaudar 5.855 dólares de 59 generosos donantes a través del acelerador de GlobalGiving, iniciamos el seguimiento preventivo a los macroproyectos que se vienen para la ciudad. 

Empezamos con el Plan maestro de drenajes pluviales, una obra que costará $300.000 millones (en su primera etapa) para intervenir los canales que atraviesan la ciudad y evitar que más de 20 barrios se sigan inundando. Hemos analizado a fondo manera como funciona la entidad encargada de ejecutar este proyecto, lo que nos ha permitido emitir varias alertas sobre malas prácticas de contratación: subcontratación, altos costos de intermediación, exceso de contratación directa, ausencia de interventoría, entre otros que resumimos en este boletín. 

El segundo proyecto que empezamos a vigilar de cerca son las obras de infraestructura de los Juegos Nacionales. Advertimos públicamente algunos riesgos que vemos en la licitación que abrió el Instituto de Recreación y Deporte -Ider- para adecuar uno de los coliseos de la ciudad. Conócelos en este video de 2 minutos.

Estas preocupaciones no solo han sido ampliamente difundidas en medios de comunicación y replicadas por líderes locales locales de diversos sectores; también fueron remitidas a la Procuraduría General de la Nación para que realice las investigaciones que sean necesarias. 

Este es el resultado del trabajo de un equipo técnico multidisciplinario conformado por una politóloga, un economista, una comunicadora social y un abogado experto en contratación pública. Próximamente, en la medida que las obras sigan avanzando, esperamos incorporar a un profesional en ingeniería para vigilar en tiempo real el estado de estas y otras construcciones.

The first months of 2018 have been very active for the Vigila Cartagena team. After raising $ 5,855 from 59 generous donors through the GlobalGiving accelerator, we initiated preventive monitoring of the macro projects that are coming to the city.

We started with the Rain drainage master plan, a work that will cost $ 300,000 million pesos (in its first stage) to intervene the channels that cross the city and prevent more than 20 neighborhoods from continuing to flood. We have thoroughly analyzed how the entity in charge of executing this project works, which has allowed us to issue several alerts on bad contracting practices: subcontracting, high intermediation costs, excessive use of direct contracting, lack of supervision, among others that we summarize in this newsletter.

The second project that we started to monitor closely is the infrastructure works of the National Games. We publicly warned about some risks that we see in the bidding that opened the Institute of Recreation and Sports-Ider-to adapt one of the city's coliseums. Learn more in this 2 minute video.

These concerns have not only been widely disseminated in the media and replicated by local leaders from various sectors; they were also sent to the Office of the Attorney General of the Nation to carry out the necessary investigations.

This is the result of the work of a multidisciplinary technical team made up of a political scientist, an economist, a social communicator and a lawyer. Soon, as the works continue to advance, we hope to incorporate a professional in engineering to help us monitor in real time the status of these and other constructions.
