Summary

The Sumarin family's house was taken by theft, a central fact ignored by the Jerusalem District Court when it rejected the Sumarin family's appeal against eviction by the Jewish National Fund. Ongoing for 30 years, their case isn't over. In the 1990's, an Israeli court & a government commission determined that expropriation of their property was in violation of Israeli law. Challenge

When the Government of Israel uses the Absentee Property Law exclusively to evict Palestinians, they fail to uphold the responsibility of a democracy to apply laws fairly and equally. Unjustly evicting the Sumarin family, during a pandemic no less, only emboldens the Government to order more evictions in Israel and in areas that Israel may unilaterally acquire through any future annexation. This risks formalizing the illegal expropriation of private Palestinian land on a massive scale.

Solution

In April 2021, Israel's Supreme Court will hear the Sumarin family's case. This fund pays anticipated lawyer fees, providing a safety net. If Israel's Supreme Court rules against them, the family must pay $23,000 in fines per the lower court that ruled in favor of the Jewish National Fund and $40,000 in eviction fees for forcible removal from their home. Should they win, returned court fees & fines will seed a revolving fund for other cases, managed by Torat Tzedek, an NGO registered in Israel.

Long-Term Impact

Long ago, the prophets envisioned that from Jerusalem, a divine spirit of global justice and moral responsibility would descend upon the world. When the Government of Israel protects the rights of the Sumarin family, this will be a first step towards establishing an Israeli legal system that will guarantee the rights of all who live there.
