Our work in the cases regarding violations of the right to adequate housing

Thanks to your donations, HIC-AL has followed-up on legal cases related to violations of the human right to adequate housing that we began defending in 2021. Specifically, in April of that year we presented an amparo on behalf of an elderly woman at risk of being evicted in the middle of the COVID-19 pandemic. This occurred due to the fact that her daughter, who lives with her and a minor chils, lost her job and was unable to pay rent. Afterwards, HIC-AL also took up her civil defense. The  amparo was brought against various authorities for failing to take any measures to prevent and mitigate the effects of the pandemic on the tenants' access to housing. It was also requested that the city take care of the rent so as not to leave the landlord neglected. 

In August 2022, the Federal Judiciary issued a ruling in which it urged the authorities of Mexico City to evaluate the situation that the vulnerable population was facing in this matter.  It also required the development of a policy to prevent and mitigate the social and economic effects of the pandemic on tenants in Mexico City. This ruling was and is an important step in the recognition and guarantee of the human right to adequate housing. However, the authorities did not comply with it. Because of this, and recognizing that the matter involves issues of great constitutional significance and unprecedented controversies, in April 2023 we filed a request for the Supreme Court of Justice of the Nation to take up the case.

Since the beginning of the year we have also worked on the follow-up of the other cases that we are handling, and we also participated in meetings with authorities of Mexico City regarding the realization of the right to adequate housing. At the end of April, we will have ready a training program for people at risk of evictions and other violations of the right to adequate housing.

Gracias a sus donaciones, desde HIC-AL hemos dado seguimiento a los casos judiciales relacionados con las violaciones al derecho humano a la vivienda adecuada que empezamos a defender en el 2021. Particularmente, en abril  de ese año presentamos una demanda de amparo a favor de una adulta mayor en riesgo de desalojo en el contexto de la pandemia por COVID-19. Lo anterior debido al hecho que su hija, que vive con ella junto a un menor de edad, ha perdido su trabajo desde entonces. Posteriormente, se asumió su defensa también en el ámbito civil. La demanda de amparo se realizó en contra de diversas autoridades por no haber adoptado ninguna medida para prevenir y mitigar los efectos de la pandemia en el acceso a la vivienda de las personas inquilinas. También se pidió que la ciudad solventara la renta para no dejar desamparado al propietario de la vivienda.

En agosto del 2022, el Poder Judicial Federal emitió una sentencia en donde exhortó a las autoridades de la CDMX a evaluar la situación por la que atraviesa la población vulnerable en esta materia y a generar una política para prevenir y mitigar los efectos sociales y económicos de la pandemia en personas inquilinas de la Ciudad de México. Esta sentencia fue y es un paso importante en el reconocimiento y la garantía del derecho humano a una vivienda adecuada, sin embargo, las autoridades no cumplieron con la sentencia. Por lo anterior y considerando que el asunto involucra temas de gran trascendencia constitucional y controversias inéditas de las cuales no hay precedentes, en el mes de abril del 2023 presentamos una solicitud de atracción del caso por parte de la Suprema Corte de Justicia de la Nación.

Desde el inicio del año seguimos además trabajando en el seguimiento de los demás casos que llevamos, participamos en reuniones con autoridades de la Ciudad de México sobre  temas relacionados con la concreción del derecho a una vivienda adecuada y a finales de abril contaremos con un programa de capacitación para personas en riesgo de sufrir desalojos y otras violaciones al derecho a una vivienda adecuada.
