Addressing the housing crisis in Mexico City

Acciones ante la crisis de vivienda en la Ciudad de México (CDMX)

La crisis de asequibilidad de vivienda en México continúa siendo un gran problema para miles de personas en el país. Para enfrentarla, particularmente en la CDMX se ha propuesto el desarrollo de políticas anti-gentrificación a partir de 14 ejes de trabajo. HIC-AL ha participado en este esfuerzo con propuestas y acciones de incidencia y ha tenido la oportunidad de presentar una iniciativa de ley de arrendamiento que se ha trabajado en años anteriores con organizaciones y movimientos urbanos.  

En este contexto, además, HIC-AL y la Clínica Jurídica de Derecho a la Vivienda María Luisa Marín, han elaborado el manual práctico para organizaciones y personas inquilinas titulado “Analizando el procedimiento de desalojo causado por juicios civiles en la CDMX a la luz del derecho a una vivienda adecuada”. En el documento se señalan las principales problemáticas que entorpecen la defensa del derecho a la vivienda y violan el derecho al debido proceso de las personas que son víctimas de juicios de arrendamiento en la ciudad y desalojo como: la falta de notificaciones sobre el inicio de juicios o la ejecución de desalojos, los tiempos limitados de defensa para lxs arrendatarixs, la falta de protección a personas vulnerables sujetas a desalojos, y la falta de una perspectiva de derechos humanos de las personas juzgadoras. Como elemento final, se desarrollan una serie de recomendaciones  para las  autoridades y tomadores de decisión, con el fin de que se modifiquen los artículos del código de procedimientos civiles identificados como problemáticos. 

De igual forma, en los últimos meses se han difundido física y virtualmente folletos informativos para dar a conocer el trabajo de la Clínica, su funcionamiento y el método de contacto para poder llegar a más personas y brindar sus servicios gratuitos. A la par de la difusión, la Clínica continúa ofreciendo asesorías (en su mayoría a mujeres de grupos vulnerables), facilitando espacios de formación para estudiantes, brindando entrevistas en medios y participando en diversos eventos, con el objetivo de mantener el tema de la vivienda como una prioridad en la agenda pública.  

Es importante mencionar que la Clínica opera con recursos sumamente limitados, por lo que su donación adquiere un valor especialmente significativo. Cada aporte contribuye directamente a fortalecer esta labor de apoyo a personas y grupos vulnerables, tanto ante procesos jurídicos y formativos como en situaciones de emergenciaAsimismo, nos permite ampliar su alcance y sostener las acciones de acompañamiento, formación, incidencia y difusión que se llevan a cabo.

Addressing the housing crisis in Mexico City 

The housing affordability crisis in Mexico continues to be a major issue for thousands of people around the country. To address this situation, the government in Mexico City has recently proposed the development of anti-gentrification policies based on 14 key areas of work. HIC-AL has contributed to this effort through proposals and advocacy strategies. We also had the opportunity to present a leasing bill initiative that we have developed over previous years along with civil society organizations and urban movements. 

In this context, HIC-AL and the Housing Rights Legal Clinic "Maria Luisa Marin" have produced a practical manual for organizations and tenants, whose title in english is “Analyzing Eviction Proceedings Caused by Civil Lawsuits in Mexico City in Light of the Right to Adequate Housing”. The document outlines the main issues that hinder the defense of the right to housing and violate the due process rights of people facing lease-related lawsuits in the city and evictions. These include lack of notification about the initiation of legal proceedings or the execution of evictions, limited timeframes for the tenants’ defense processes, lack of protection for vulnerable individuals facing evictions, and the absence of a human rights perspective among judges. The manual concludes with a series of recommendations for authorities and decision-makers, aiming to amend problematic articles of the civil procedure code. 

Additionally, in the last months, we have disseminated informational materials both physically and digitally to make the Clinic’s work more widely known, as well as its operation, and how to get in touch to receive their services. At the same time, the Clinic continues to provide legal advice (mostly to women from vulnerable groups), facilitate training spaces for students, offer interviews to the media, and participate in various events, all with the goal of keeping housing issues at the forefront of the public agenda. 

It is important to note that the Clinic operates with extremely limited resources, which makes your donation especially meaningful. Each contribution directly helps strengthen this support work for individuals and vulnerable groups, both in legal and formative processes and emergency situations. It also allows us to expand our reach and maintain ongoing efforts in legal assistance, training, advocacy, and public awareness.
