By Lea Ramos | Programs Director - Mediation Services
When Lucia learned she was being sued by her previous rental management company, she responded with intention rather than avoidance. After graduating from law school into a difficult job market, she carried significant student debt and faced financial strain. When her rent became unmanageable, she made the responsible decision to seek more affordable housing, even though it meant breaking her lease. She never denied that she owed money. What mattered was resolving the issue honestly and, in a way, she could follow through on.
Drawing on her background in mediation, she chose to face the situation directly, seeking a solution that was fair, realistic, and respectful to everyone involved. Rather than waiting for the court to decide, she reached out to CCR to request mediation.
The rental management company also demonstrated good faith. When contacted, they agreed to participate in mediation, recognizing the value of resolving the dispute efficiently and professionally. Lucia came to mediation prepared, clearly outlining what she believed she owed and what she could reasonably pay. Her openness set a collaborative tone and kept the conversation focused on solutions rather than blame. The management company representative, Michael, and attorney, Chris, approached the conversation with respect, aiming to treat this situation as they would any similar case while preserving their reputation for fairness.
During mediation, Lucia, Michael, and Chris listened carefully and communicated directly. They reviewed lease terms, security deposits, partial payments, and court costs together, taking time to understand each other's perspectives. This shared effort—speaking openly in a neutral space—proved far more effective than previous written exchanges.
Their cooperation led to a practical outcome. Based on Lucia's commitment to repayment, the management company agreed to reduce the total amount owed to around $4,000 and accept monthly payments instead of a lump sum. The agreement reflected mutual trust and accountability.
By choosing mediation, Lucia and Michael avoided a lengthy and uncertain court process. The management company secured a clear path to payment, allowing them to focus on current tenants. Lucia gained relief, stability, and the ability to move forward without the stress of ongoing litigation.
