Mutual Respect and Shared Goals

Fabio has been a landlord for over 5 years. He prides himself on consistently demonstrating his commitment to supporting his tenants, from addressing maintenance issues promptly to being flexible with payment arrangements when needed. Mario and his family - his wife and two young children - moved into Fabio’s well-maintained two-bedroom property about 2 years ago, seeking a stable home in a safe neighborhood. As the main provider for his family, Mario focuses on ensuring their safety and security while maintaining a comfortable living environment.

Four months ago, Mario unexpectedly lost his job due to company downsizing and he stopped paying rent to Fabio. He found himself in an increasingly difficult situation, feeling trapped by circumstances beyond his control and without clear options for moving forward. Before this challenging period, Fabio and Mario’s relationship had been notably positive and cooperative. Despite their language differences—Mario primarily speaks Spanish while Fabio speaks English, they had always managed to find creative ways to communicate effectively with each other.

Both men were referred to mediation regarding the eviction matter filed by Fabio. While the situation involved an impending eviction, both entered the process open to understanding and finding a mutually beneficial solution. Recognizing a language barrier, a certified interpreter joined the Zoom session to support clear and respectful communication.

From the beginning, Fabio expressed empathy for Mario and acknowledged their shared experience as immigrants, emphasizing that initiating legal action was a difficult but necessary step given his upcoming departure for a Peace Corps assignment. He explained that selling the building was essential before he left, and the unresolved tenancy issue was delaying that process.

Mario, in turn, responded with heartfelt appreciation for Fabio’s patience. He explained that a recent job loss and the resulting financial hardship had left him without a car or phone—essential tools for his work and communication. The inability to reach Fabio weighed heavily on him, and he was grateful for the opportunity to clarify the situation. Mario offered a new contact number and expressed his desire to resolve the issue honorably.

Despite the stress they each faced, both Mario and Fabio centered the conversation on mutual respect and their shared hope for a fair resolution. Mario emphasized his gratitude for Fabio’s understanding, and Fabio recognized Mario’s integrity and effort to make things right despite difficult circumstances.

At this point, the mediator asked if they had any ideas or options for resolving the situation. Fabio offered to forgive all back rent if Mario could move out by the end of the month. Mario agreed and, wanting to support Fabio in turn, suggested they apply together for a rental assistance program that might allow Fabio to recover some of the lost rent. Both men were engaged in problem-solving.

To further ease the transition, Fabio offered Mario the furniture from the apartment as a parting gift, a gesture that deeply moved Mario. He placed his hand over his heart and thanked Fabio with visible emotion, acknowledging the generosity at a moment when he himself felt he had little to give. The moment reflected the sincerity and mutual regard that shaped the entire mediation.

The interpreter played a vital role in supporting clear communication, allowing both parties to listen actively, speak with care, and stay solution-focused throughout. The mediation concluded with a written agreement: Mario would vacate the apartment by month’s end, the two would jointly pursue the rental-assistance application, and the furniture would remain with Mario and his family.

Fabio and Mario left the session with a shared sense of relief and appreciation. Their respectful dialogue and willingness to collaborate had led to a resolution that not only addressed the immediate issue but also honored their shared values, Fabio’s dedication to service and integrity, and Mario’s resilience and responsibility. The mediation gave both men a way forward that was grounded in mutual dignity and hope.
