Taiwan is often hailed as an LGBTQ+ beacon in Asia, yet a cruel reality remains: transgender individuals must undergo invasive surgery to remove their reproductive organs to change their legal gender. This project, led by TAPCPR, aims to abolish this inhumane requirement through strategic litigation and constitutional challenges. By training human rights lawyers and fostering public education, we strive for a future where gender identity is recognized with dignity, without surgical coercion.
Current Taiwanese law requires two psychiatric diagnoses and full surgical removal of sex organs for legal gender recognition. Over 90% of transgender people in Taiwan cannot meet this high-cost, high-risk, and inhumane threshold. Without updated IDs, they face constant "outing" in daily life-from opening bank accounts to picking up parcels-leading to pervasive discrimination, misgendering, and threats to their safety in both public and private sectors.
Since 2021, we have won seven consecutive cases, but the government refuses to change the policy for all, claiming these rulings apply only to individuals. Our three-pronged strategy includes: Strategic Litigation: Launching a Constitutional challenge to strike down the forced surgery requirement nationwide. Legal Empowerment: Training gender-sensitive lawyers for accessible trans legal support. Public Education: Reducing stigma, fostering inclusion and empathy.
Our ultimate goal is a systemic overhaul: replacing the surgical mandate with a self-determination model. By removing the financial and physical barriers to legal recognition, we will liberate thousands of transgender people from state-mandated sterilization. This change will ensure equal access to employment, healthcare, and education, cementing Taiwan's role as a true human rights leader and providing a roadmap for transgender rights across Asia.
