Lesson of Grandfather Spruce

Nearly a year has passed since agents of the transmission company that holds the easement on our property showed up and marked our 120-year old spruce and walnuts with big blue x’s to be cut down—not trimmed as had been done since 1970. Since we purchased the Lake Geneva location in 1994 because of the trees that grew in an area 450 feet long and 40 feet wide near the roadside—this came as a horrible shock. We had built the outdoor habitats in the belief that the trees would always be there to shield the wildlife from traffic noise, human activity and the elements.

When we came to you, our supporters, with this project to raise funds for the legal battle, it was only after months of negotiation had failed.

After a four-day trial in October, the Judge ruled against us.   The order that protected the trees was removed and 18,000 square feet of old trees and young vegetation was removed on October 31.  In less than 48 hours, the 120-year old Norway Spruce and the rest of the trees were gone, leaving a barren brown scar beneath where a deep and towering curtain had once sheltered the sanctuary. 

Though we did not prevail in court, thanks to your help, we had the opportunity to make our case, and because we did so in a respectful and civil way, when the cutting at Fellow Mortals was done, the workers did so with consideration and care to limit the disturbance and noise to the wild ones that could not be moved indoors—and even watched out for wild Mama deer and her fawn who make our property their home.

Through the months of negotiation and legal proceedings, we  educated thousands of people about easements, the laws that protect nesting birds and wildlife, and the environmental benefits of trees.  And while the injunction to stop clear cutting was temporary—this small victory saved thousands of wild birds and mammals from death and injury that would have come with cutting and use of heavy equipment during the height of nesting season.  Finally, and importantly, in the process of making the case to save the trees, legal history was made with our attorneys' argument that centered on the value of wild lives and the work of wildlife rehabilitators on their behalf.

We are sad to have lost the old spruce that was so much a part of Fellow Mortals—yet its descendants now spread their boughs to the sun where they once stood in the shadow of Grandfather Spruce.   Injuries were inflicted, and may be again, but wounds will heal, and scars will always be what we make of them.
