Every child has a right to their childhood – a hopeful existence free of exploitation, violence, neglect, and extreme poverty. Children need education, health services, consistent support systems as well as love, hope and encouragement; all these things and more are required in order to experience childhood to the fullest, and to eventually develop into healthy, capable adults.

       However, millions of young people around the world are exploited in different ways. Children are forced to work in factories, in backrooms, on the street, and in the sex trade. They can be sold as slaves or even drafted to fight in wars. The violation of children’s rights is pervasive throughout many countries and fuels struggling economies, but exploitation of children is not restricted to the public sphere. Alarmingly, children are too often the recipients of violence in their own home, where a high percentage of abuse- sexual, physical, emotional, and psychological- takes place.

But much more needs be done to enforce children’s rights everywhere. children’s get their rights and protection.

Objectives:         

      At the end of session participents (Peer educators) should be able to:

  • Understand the legal rights
  • Understand the Sexual exploitation
  • Enable to protect themselves and peers
  • Enable to report sexual exploitation Cases

Session was started with the residing of holly Quran then trainer introduced him self and all participants have also introduced them selves; the session was on Legal Rights. This session was conducted for Peer Educators. In this session CA members & CPC children have participated.

Contents of the session

  1. Procedure of Court and offences.
  2. Kinds of court.
  3. How to register compliant in police station.
  4. How to file a direct compliant in court. (According to criminal procedure code with sections).
  5. Reporting of Exploitation cases

 Following were the topics discussed with peer educators

 Section 154                 Registration of FIR? Case

 Section 160                 Police officer power to require attendance of the witnesses

 Session 161                 Examination of the witnesses by police

 Section 64                   Power to record statements and confession of accused. Before the

 Judicial magistrate

Section 167                 procedure when investigation can not be completed in twenty four hours (Remand)

Section 169                 release of accused when evidence deficient.

 Section173                  Chelan and other complete documents will be submitting the court though public prosecutor/ district attorney.

 Section 377                 Un natural offence male to make sexual abuse and acts is done.

 Threat of life: any person threats any one do this thing other wise will kill you. If this is legal or illegal and this person compel you to do this thing. You have to go to police station and file a compliant under section107/ 150cr.pc. Police will arrest him and if it will prove against the person who is involved in this threat or breach of piece of any one he will face the trail and punished.

 Framing of charge and case trail will be start

Section -200                Direct compliant before the judicial magistrate of session judge.

 If Police refuse to register the case /FIR. Section 22(a) will support the compliant to fill an application against the SHO and session judge has to power to call the station head officer (SHO) and issue the direction to file the case or inquire about the matter under section 182.

If a criminal is less than 7 years.

 Section 82PPC: is clear that no thing is an offence which done by a child under 7 years.

 Section 83 PPC Act of a child above seven years and under twelve of immature understanding. Court will observe the maturity of understanding.

 Juvenile Justice system ordinance 2000

 Aim of the ordinance: Protection to the children involved in criminal litigation and their rehabilitation of the society.

 Definition of child: A minor who is below the eighteen at the time of offence is called child.

Bristol Institution: A place where child offender may be detained and given education and training for their mental, moral and psychological development.

 Procedure of juvenile courts

A juvenile court shall not ordinarily take up any case on a day when the case of a child accused is fixed for evidence on such day.

No person shall be present at any sitting of a juvenile court except presiding officer, staff of the court parties and guardian of the child
